1. Agreement to these Terms

These Terms of Service (“Terms”) govern your use of the websites, applications and games operated by DZERCALCE STUDIO (“we”, “us”, “the Studio”), including dzerkalce.com, AI Family OS: Parenting Guide and Siege the Summit (together, the “Services”).

By creating an account, installing an application, making a purchase or otherwise using the Services, you confirm that you have read and accept these Terms. If you do not agree with them, please do not use the Services.

These Terms work together with our Privacy Policy, which explains what data we process and why.

2. Eligibility and age requirements

• AI Family OS: Parenting Guide is intended for parents, guardians and caregivers aged 18 or over. It is not designed for use by children. A parent may create a child profile, but the account holder and the person interacting with the Service must be an adult.
• Siege the Summit is available to users who meet the minimum age of the app store rating in their country and who are at least 13 years old. If you are a minor, you may use the game only with the consent and supervision of a parent or guardian, who accepts these Terms on your behalf.
• If you are in the European Economic Area and under the age required for digital consent in your country (13–16 depending on the member state), a parent or guardian must provide that consent.

3. Accounts

Some features require an account. You agree to provide accurate information, to keep your credentials confidential, and to remain responsible for everything that happens under your account. Tell us promptly at yuriyalexsov@gmail.com if you believe your account has been compromised.

One person may hold one account per Service. Creating multiple accounts to gain an advantage — for example to claim referral rewards repeatedly or to manipulate leaderboards — is not permitted (see Section 9).

4. AI Family OS: subscriptions and billing

AI Family OS is offered on a freemium basis: a free tier with limited functionality and a paid Premium tier.

Prices are shown in US dollars and may be converted and taxed according to your country and payment provider. Payments are processed by Stripe or by the app store you purchased through (Google Play Billing, Apple App Store) — we never receive or store your full card details.

4.1. Automatic renewal and cancellation

Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can cancel at any time:

• Purchased in Google Play or the App Store: through the subscription settings of that store. We cannot cancel a store subscription on your behalf.
• Purchased via Stripe on the web: through your account settings, or by writing to us.

After cancellation you keep Premium access until the end of the period you have already paid for. We do not provide partial refunds for an unused portion of a period, except where the law requires it.

4.2. Refunds

Purchases made through Google Play or the App Store are refunded under those stores’ own policies, and requests must be made to them. For purchases made directly through Stripe, contact us within 14 days of payment.

5. Siege the Summit: virtual items and purchases

5.1. Virtual currency and items

The game contains virtual currency (gold, coins) and virtual items (rockets, shields, skins, badges, league progress). These are licensed to you for personal entertainment within the game. They are not your property and:

• have no monetary value outside the game and cannot be exchanged for money, goods or services;
• cannot be sold, traded, gifted or transferred to another account or to a third party;
• cannot be cashed out, refunded as currency, or inherited;
• may be adjusted, rebalanced or removed as part of game balancing, and may be lost if your account is terminated for a breach of these Terms.

5.2. In-app purchases

The game offers optional paid content, for example:

Prices, contents and availability may change. A Battle Pass grants access to seasonal content for the duration of that season only; rewards not claimed before the season ends are forfeited.

In-app purchases are final once delivered, subject to the refund policy of the store you purchased through and to any mandatory consumer rights you have.

5.3. Referral codes

Referral rewards are granted only for genuine new players. We may withhold or reverse rewards, and suspend the accounts involved, where we detect self-referral, automated registration, duplicate devices or any other manipulation of the referral system.

6. Advertising

Our Services are partly supported by advertising:

• Rewarded video in Siege the Summit is always voluntary. You choose to watch an advertisement in exchange for an in-game benefit such as a revive, a reward multiplier or a booster. Declining costs you nothing but that benefit.
• Interstitial advertisements may appear between matches, on results screens. They never interrupt an ongoing battle.
• Display advertising may appear on dzerkalce.com alongside editorial content.

Advertising is delivered by Google (Google AdSense, Google H5 Games Ads and Google AdMob). Advertisers are third parties and we do not control the content of their creatives. How advertising data is handled is described in our Privacy Policy.

Premium subscribers and paid game content may reduce or remove certain advertising formats where stated at the point of purchase.

7. Important notice about parenting guidance

AI Family OS is also not a technical control tool: it does not block applications, filter content or enforce device time limits. Decisions about your child remain yours.

8. Content generated by automated systems

Parts of the Services produce text using artificial intelligence. Such output may occasionally be inaccurate, incomplete or unsuitable for your situation. Please review it critically before acting on it. We do not warrant that automated output is error-free.

9. Acceptable use

When using the Services you agree not to:

• cheat, exploit bugs, use bots, scripts, modified clients, packet manipulation or any tool that gives an unfair advantage in the game;
• create multiple accounts to farm rewards, manipulate matchmaking or distort leaderboards;
• buy, sell or advertise accounts, virtual currency or items;
• harass, threaten, impersonate or abuse other users, or post unlawful, hateful or sexually explicit content;
• attempt to access accounts, servers or data you are not authorised to access, or disrupt our infrastructure;
• scrape, copy or republish substantial parts of our content for commercial purposes without written permission;
• reverse engineer, decompile or modify our applications, except where such restriction is prohibited by law.

10. Content you submit

You keep ownership of what you submit — nicknames, messages, feedback, child profile entries. By submitting it you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content solely to operate and improve the Services.

You are responsible for what you submit and confirm you have the right to submit it. We may remove content that breaches these Terms or the law.

11. Our intellectual property

The Services, including software, source code, game mechanics, artwork, 3D assets, audio, text, the DZERCALCE name and logo, and the names AI Family OS and Siege the Summit, are owned by DZERCALCE STUDIO or its licensors and are protected by copyright and trade mark law.

We grant you a limited, personal, non-transferable, revocable licence to use the Services for their intended purpose. No other rights are granted.

12. Availability and changes to the Services

We work to keep the Services available but do not guarantee uninterrupted operation. Maintenance, updates, technical failures or matters outside our control may cause interruptions.

We may add, change, suspend or discontinue features, game modes, seasons or entire Services. If we discontinue a paid Service entirely, we will give reasonable advance notice by email or in-app, and will address outstanding paid entitlements fairly.

13. Suspension and termination

You may stop using the Services and delete your account at any time by writing to yuriyalexsov@gmail.com. Deletion of your data is described in the Privacy Policy.

We may suspend or terminate an account that materially breaches these Terms, in particular Section 9. Where proportionate and lawful we will warn you first. Termination for a serious breach may result in the loss of virtual currency, items and progress, without refund.

14. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or for your mandatory consumer rights.

15. Limitation of liability

To the fullest extent permitted by law, DZERCALCE STUDIO shall not be liable for indirect, incidental, special or consequential damages, loss of profit, loss of data, or loss of virtual items or progress arising from your use of the Services.

Where liability cannot be excluded, our total aggregate liability is limited to the greater of: the amount you paid us for the relevant Service in the twelve months preceding the event, or USD 100.

16. Your consumer rights in the EU and UK

If you are a consumer resident in the European Union, the European Economic Area or the United Kingdom, you have a statutory right to withdraw from a distance contract within 14 days without giving a reason.

Please note that for digital content delivered immediately, this right is lost once delivery has begun with your express prior consent and your acknowledgement that you thereby lose the right of withdrawal. You give that consent when you confirm an in-app purchase that is delivered instantly.

These Terms do not affect mandatory consumer protection rules of the country in which you reside.

17. Third-party platforms

The Services are distributed and supported through third parties including Google Play, the Apple App Store, Stripe and Google advertising services. Your use of those platforms is also governed by their own terms. We are not responsible for their operation, pricing decisions, refund rulings or availability.

18. Changes to these Terms

We may update these Terms as our products evolve. The effective date at the top of this page always shows the current version. For material changes affecting your rights or paid services we will provide notice by email or in-app at least 14 days before they take effect. Continuing to use the Services after that date means you accept the updated Terms.

19. Governing law and disputes

These Terms are governed by the law of Ukraine, without regard to conflict-of-law rules, and disputes shall be submitted to the competent courts of Kyiv, Ukraine. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, nor of your right to bring proceedings there.

Before any formal proceedings, please contact us — most issues are resolved quickly by email.

1. Прийняття умов

Ці Умови використання («Умови») регулюють користування сайтами, застосунками та іграми, які надає DZERCALCE STUDIO («ми», «Студія»), зокрема dzerkalce.com, AI Family OS: Parenting Guide та Siege the Summit (разом — «Сервіси»).

Створюючи акаунт, встановлюючи застосунок, здійснюючи купівлю або іншим чином користуючись Сервісами, ви підтверджуєте, що прочитали та приймаєте ці Умови. Якщо ви з ними не згодні — будь ласка, не користуйтеся Сервісами.

Умови діють разом із Політикою конфіденційності.

2. Вік користувача

• AI Family OS: Parenting Guide призначено для батьків та опікунів віком від 18 років. Застосунок не призначено для самостійного використання дітьми. Батьки можуть створити профіль дитини, але власником акаунта має бути доросла особа.
• Siege the Summit доступна користувачам віком від 13 років, які відповідають віковому рейтингу магазину застосунків у своїй країні. Неповнолітні можуть грати лише за згодою та під наглядом батьків чи опікунів, які приймають ці Умови від їхнього імені.

3. Акаунти

Ви зобов’язуєтесь надавати достовірні дані, зберігати дані для входу в таємниці та нести відповідальність за дії, вчинені під вашим акаунтом. Про підозру на компрометацію акаунта повідомте на yuriyalexsov@gmail.com.

Одна особа може мати один акаунт у кожному Сервісі. Створення кількох акаунтів для отримання переваги заборонено (див. розділ 9).

4. AI Family OS: підписка та оплата

Застосунок працює за моделлю freemium: безкоштовний рівень з обмеженим функціоналом і платний рівень Premium.

Платежі обробляють Stripe або магазин застосунків (Google Play Billing, Apple App Store). Ми не отримуємо і не зберігаємо повні дані вашої картки.

4.1. Автопродовження та скасування

Підписка продовжується автоматично, якщо її не скасовано щонайменше за 24 години до дати продовження. Підписку, оформлену в магазині застосунків, скасовують у налаштуваннях того магазину — ми не можемо зробити це за вас. Після скасування доступ зберігається до кінця вже оплаченого періоду. Часткове повернення за невикористану частину періоду не здійснюється, крім випадків, передбачених законом.

4.2. Повернення коштів

Купівлі через Google Play чи App Store повертаються за правилами цих магазинів. За купівлями через Stripe звертайтеся до нас протягом 14 днів з дати оплати.

5. Siege the Summit: віртуальні предмети та покупки

Гра містить віртуальну валюту (золото, монети) і предмети (ракети, щити, скіни, бейджі, прогрес у лігах). Вони надаються вам за ліцензією для особистого використання в грі та не є вашою власністю. Зокрема, вони:

• не мають грошової вартості поза грою і не обмінюються на гроші, товари чи послуги;
• не підлягають продажу, обміну, даруванню чи передачі іншому акаунту;
• не виводяться у готівку та не успадковуються;
• можуть бути змінені або вилучені в межах балансування гри, а також втрачені у разі блокування акаунта за порушення цих Умов.

Battle Pass діє лише протягом відповідного сезону; нагороди, не отримані до його завершення, анулюються.

Реферальні коди. Винагорода нараховується лише за справжніх нових гравців. Ми можемо скасувати винагороду та заблокувати акаунти в разі самореферальності, автоматичної реєстрації чи іншої маніпуляції.

6. Реклама

• Відео з винагородою в Siege the Summit завжди добровільне: ви самі обираєте переглянути рекламу в обмін на ігровий бонус. Відмова не тягне жодних наслідків, крім неотримання цього бонусу.
• Міжраундова реклама може показуватись на екранах результатів і ніколи не перериває бій.
• Медійна реклама може розміщуватись на dzerkalce.com поруч із редакційним контентом.

Рекламу надає Google (AdSense, H5 Games Ads, AdMob). Ми не контролюємо зміст рекламних оголошень третіх сторін.

7. Важливе застереження щодо порад із батьківства

AI Family OS також не є технічним засобом контролю: він не блокує застосунки, не фільтрує контент і не обмежує екранний час. Рішення щодо дитини залишаються за вами.

8. Контент, створений автоматизованими системами

Частина Сервісів генерує текст за допомогою штучного інтелекту. Такий результат може містити неточності. Оцінюйте його критично. Ми не гарантуємо безпомилковість автоматично згенерованого контенту.

9. Правила користування

Користуючись Сервісами, ви зобов’язуєтесь не:

• використовувати чити, боти, скрипти, модифіковані клієнти чи помилки гри для отримання переваги;
• створювати кілька акаунтів для накрутки нагород або спотворення таблиць лідерів;
• купувати, продавати чи рекламувати акаунти, віртуальну валюту та предмети;
• переслідувати, ображати чи видавати себе за інших користувачів, поширювати протиправний контент;
• отримувати несанкціонований доступ до акаунтів, серверів чи даних, порушувати роботу інфраструктури;
• масово копіювати чи перепубліковувати наш контент у комерційних цілях без письмового дозволу;
• здійснювати зворотну розробку застосунків, окрім випадків, дозволених законом.

10. Ваш контент

Ви зберігаєте права на матеріали, які надсилаєте (нікнейми, повідомлення, відгуки, записи профілю дитини). Надсилаючи їх, ви надаєте нам невиключну безоплатну ліцензію зберігати й відтворювати цей контент виключно для роботи та вдосконалення Сервісів.

11. Інтелектуальна власність

Сервіси — зокрема програмний код, ігрові механіки, графіка, 3D-моделі, аудіо, тексти, назва та логотип DZERCALCE, назви AI Family OS і Siege the Summit — належать DZERCALCE STUDIO та захищені авторським правом і правом на торговельні марки. Вам надається обмежена персональна невідчужувана ліцензія на використання Сервісів за призначенням.

12. Доступність та зміни Сервісів

Ми прагнемо забезпечити стабільну роботу, але не гарантуємо безперебійність. Ми можемо додавати, змінювати або припиняти функції, режими, сезони чи Сервіси. У разі повного припинення платного Сервісу ми повідомимо завчасно та справедливо врегулюємо питання оплачених прав.

13. Призупинення та припинення

Ви можете припинити користування та видалити акаунт у будь-який час, написавши на yuriyalexsov@gmail.com. Ми можемо призупинити або заблокувати акаунт за суттєве порушення цих Умов, зокрема розділу 9. Блокування за грубе порушення може призвести до втрати віртуальної валюти, предметів і прогресу без відшкодування.

14. Відмова від гарантій

У межах, дозволених законом, Сервіси надаються «як є» та «як доступно», без будь-яких прямих чи непрямих гарантій. Ніщо в цих Умовах не обмежує відповідальність, яку не можна обмежити за законом.

15. Обмеження відповідальності

У межах, дозволених законом, DZERCALCE STUDIO не несе відповідальності за непрямі чи побічні збитки, втрачену вигоду, втрату даних або віртуальних предметів і прогресу. Сукупна відповідальність обмежується більшою з величин: сумою, сплаченою вами за відповідний Сервіс за дванадцять місяців до події, або 100 USD.

16. Права споживачів у ЄС

Споживачі з ЄС, ЄЕЗ та Великої Британії мають право відмовитися від договору протягом 14 днів без пояснення причин. Для цифрового контенту, що надається негайно, це право втрачається з моменту початку надання за вашої прямої згоди — таку згоду ви надаєте, підтверджуючи покупку з миттєвою доставкою.

17. Сторонні платформи

Сервіси розповсюджуються через Google Play, Apple App Store, Stripe та рекламні сервіси Google. Користування ними регулюється також їхніми власними умовами.

18. Зміни Умов

Ми можемо оновлювати ці Умови. Актуальну редакцію позначено датою набрання чинності вгорі сторінки. Про суттєві зміни, що стосуються ваших прав або платних послуг, ми повідомимо щонайменше за 14 днів.

19. Застосовне право

Ці Умови регулюються правом України; спори розглядаються компетентними судами міста Києва. Для споживачів це не позбавляє вас захисту імперативних норм права країни вашого проживання. Перед зверненням до суду, будь ласка, напишіть нам — більшість питань вирішується електронною поштою.
